Apple and At&t causing 3G network issues by overselling iPhone 3G?

Apparently that’s the official word from a San Diego-based lawsuit filed against Apple and At&t which alleges they knowingly oversold iPhone 3G and promised fast speeds, but failed to deliver.  Personally we have witnessed first hand the demise of At&t’s 3G network in our area which was hitting speeds upwards of 1500kbps with our Nokia N95-3.  Currently the highest speeds we have ever hit to date with the iPhone 3G were in the 700kbps area (yes even at an At&t store, full bars, etc).

According to the lawsuit filed by William Gills,  failed claims by both At&t and Apple about the speed of the Internet on the device and the service by the carrier are to blame.  There are plenty of additional assertions in the 18-page complaint, but we don’t really need to get into all of that now.  In the meantime, we understand that the problems exist and we are sure improvements will be made with the next software upgrade by Apple and network upgrades by At&t.
